The Fair Debt Collection Practices Act (FDCPA) was implemented to protect consumers from the harassment and abuse of debt collectors. If you are constantly being called by a debt collector even though you have asked them to stop calling, you may be entitled to up to $1,000 in damages. Debt collectors are also not allowed to call outside the hours of 8:00 AM-9:00 PM or continue calling after the consumer has given written validation of receiving and not wanting the calls to continue. Though there are rules in play from the FDCPA, plenty of debt collectors continue to violate these rules. Some businesses may even sell your number to a debt collecting company which further violates the FDCPA. To find out if the debt collector contacting you is in violation of the FDCPA, click here.
